General Conditions of Sale

Hereafter referred to as « the Seller ».

2. Subject matter

These General Conditions of Sale (GTC) govern all sales of products made on the site apsaraco.com, as part of a distance selling system.

3. Products

The products offered for sale are: natural and ecological productsavailable within stock limits.

Each product is accompanied by as precise a description as possible.
Photographs and visuals do not have contractual value.

4. Prices

Prices are shown in CFP francs (XPF), all taxes included (including GCT)unless otherwise stated.

The Seller reserves the right to change his prices at any time.
The applicable price is that displayed at the time of validation of the order.

5. Command

The Customer can place an order directly on the site apsaraco.com.

The order process includes:

• the selection of the product(s);

• validation of the basket;

• the entry of delivery and billing information;

• choice of method of delivery;

• the choice of payment method;

• the final validation of the order.

The validation of the command means full acceptance of these GTCs.

A confirmation email is sent to the Customer at the address indicated when ordering.

6. Payment

Payment is made online via the means offered on the site (e.g. EpayNC, Stripe, or equivalent), at the time of validation of the order.

Transactions are secured according to the standards of the selected payment provider.
Flow occurs immediately when the command is validated (unless otherwise stated on the site).

7. Delivery

The products are delivered to the address indicated by the Customer when ordering.

The estimated delivery costs, terms and times are specified before the order is validated.

The Seller may not be held liable for delays attributable to the carrier or a case of force majeure.

The Customer is required to check the condition of the package at reception. In case of anomaly (damaged, open, missing product...), it belongs to the Customer:

• to issue specific reservations to the carrier;

• and inform the Seller as soon as possible by email to contact@apsaraco.com.

8. Right of withdrawal

The Customer has a period of 14 calendar days from the date of receipt of the product to exercise its right of withdrawal, without having to justify its decision.

In order to exercise this right, the Customer must notify the Seller of its decision (by email to contact@apsaraco.com) indicating a minimum: surname, first name, order number, product(s) concerned, and withdrawal decision.

The costs of return are borne by the Customer.

The product must be returned in perfect condition, in its original packaging if possible, and accompanied by any accessories.

Reimbursement shall take place within a maximum period of 14 days from receipt of the returned product (or from proof of dispatch, at the choice of the Seller), according to the same means of payment as used in the order, unless otherwise agreed.

9. Exclusions from the right of withdrawal

The right of withdrawal shall not apply in particular to:

• customised products;

• aux produits descellés ne pouvant être retournés pour des raisons d’hygiène ou de protection de la santé ;

• aux biens périssables ou susceptibles de se détériorer rapidement.

10. Garanties

Les produits bénéficient des garanties légales applicables, conformément à la réglementation en vigueur en Nouvelle-Calédonie.

Toute demande au titre des garanties doit être adressée par email à contact@apsaraco.com, en précisant : numéro de commande, produit concerné, description du problème, photos si nécessaire.

11. Responsabilité

Le Vendeur ne saurait être tenu responsable des dommages indirects résultant de l’achat des produits ou de l’utilisation du site, notamment perte d’exploitation, perte de chance, ou préjudice immatériel.

La responsabilité du Vendeur ne pourra en tout état de cause excéder le montant de la commande concernée.

12. Données personnelles

Les informations collectées sont nécessaires au traitement des commandes (gestion, livraison, facturation, service client).

Le Client dispose d’un droit d’accès, de rectification et de suppression des données le concernant, en écrivant à : contact@apsaraco.com.

13. Propriété intellectuelle

Tous les éléments du site apsaraco.com (textes, images, logos, graphismes, contenus) sont protégés par le droit de la propriété intellectuelle et demeurent la propriété exclusive du Vendeur, sauf mention contraire.

Toute reproduction, représentation ou exploitation, totale ou partielle, est interdite sans autorisation écrite préalable.

14. Droit applicable – Litiges

Les présentes CGV sont soumises au droit applicable en Nouvelle-Calédonie.

En cas de litige, le Client et le Vendeur s’engagent à rechercher une solution amiable avant toute action judiciaire.
